Terms and Conditions

These terms govern your purchase and use of products and services sold by American Lean Software Development LLC ("American Lean", "we", "us") through americanlean.ai. By placing an order you agree to them. If you are buying on behalf of an organization, you confirm you are authorized to bind that organization.

What we sell

We offer three categories of products and services:

We do not ship physical goods. Nothing on this website constitutes an offer to sell securities or investment advice.

Orders, pricing and taxes

Prices are displayed in US dollars (USD) unless stated otherwise at checkout. We may change prices at any time; the price applicable to your order is the one shown at the moment you complete payment. Existing subscriptions keep their price until the end of the current billing period, and we will give at least 30 days' notice before a renewal price change.

Prices are exclusive of sales tax, VAT, or equivalent indirect taxes unless expressly stated. Where we are required to collect such taxes, they are calculated and added at checkout based on your location. If you are a business in a jurisdiction operating a reverse-charge mechanism, you are responsible for accounting for the tax and must provide a valid tax identification number.

Payment

Payments are processed by Stripe, Inc. We do not receive or store your full card number. Your use of the payment flow is also subject to Stripe's own terms. Charges will appear on your statement as AMERICANLEAN.AI, sometimes followed by a short product code such as AMLEAN* SAAS. If you do not recognize a charge, please contact us before disputing it — see the "Disputes" section below.

Delivery

Digital content and software access are delivered immediately after payment is confirmed, by download link, streamed access, or account provisioning. It is your responsibility to provide a valid email address and to check spam filters. If you have not received access within one hour of payment, contact info@americanlean.ai and we will resolve it.

Consulting engagements are delivered according to the schedule agreed in the applicable proposal or statement of work.

Subscriptions and renewals

Subscriptions renew automatically at the end of each billing period until cancelled. You may cancel at any time from your account or by emailing us; cancellation takes effect at the end of the current period and you retain access until then. Usage-based charges are billed in arrears for usage actually consumed.

If a payment fails, we may retry it and may suspend access until payment succeeds. Persistent non-payment may result in termination and deletion of associated data after reasonable notice.

Refunds

Refund terms differ by product type and are set out in full in our Refund Policy, which forms part of these terms.

Licence and acceptable use

On payment, we grant you a limited, non-exclusive, non-transferable, revocable licence to access and use the purchased software or content for your own internal business or professional purposes. Unless we agree otherwise in writing, you may not resell, sublicense, publish, share credentials for, or redistribute our software or content; use it to build a competing product; remove proprietary notices; or reverse-engineer the software except where that restriction is prohibited by law.

Licences for digital content are granted to a single named individual. Team and site licences are available — contact us.

Intellectual property

All intellectual property in our software, course materials, e-books, documentation, methodologies, and brand remains the property of American Lean or its licensors. Deliverables produced specifically for you within a consulting engagement are assigned or licensed to you as set out in the applicable statement of work; our pre-existing know-how, tools, and templates remain ours.

Your content and data

You retain ownership of data you upload to our platforms. You grant us the limited right to process it as necessary to provide the service. You are responsible for having the rights to that data and for ensuring its use does not breach applicable law. Our handling of personal data is described in our Privacy Notice.

Service availability

We aim for continuous availability of our software but do not guarantee uninterrupted service. We may perform maintenance, and we may modify or discontinue features. If we discontinue a paid feature you rely on materially, you may cancel and receive a pro-rata refund of any prepaid, unused period.

Warranties and disclaimers

Our software, content, and training are provided on an "as is" and "as available" basis. To the maximum extent permitted by law, we disclaim all implied warranties, including merchantability, fitness for a particular purpose, and non-infringement.

Our materials describe methods and tools for industrial operations and AI adoption. They are informational and do not replace your own engineering judgment, safety assessment, regulatory compliance, or professional advice. You remain solely responsible for decisions taken in your operations and for compliance with all applicable safety and industry regulations.

Limitation of liability

To the maximum extent permitted by law, neither party is liable for indirect, incidental, special, consequential, or punitive damages, nor for lost profits, lost revenue, lost production, or loss of data. Our total aggregate liability arising out of or relating to these terms is limited to the amount you paid us in the twelve months preceding the event giving rise to the claim. Nothing in these terms excludes liability that cannot be excluded by law, including for fraud or death or personal injury caused by negligence.

Disputes and chargebacks

If something is wrong with your order, contact info@americanlean.ai first. We respond to all enquiries within two business days and will resolve legitimate issues promptly. Filing a chargeback without contacting us first delays resolution for everyone. We reserve the right to contest chargebacks that are inconsistent with these terms and to suspend accounts with a history of fraudulent disputes.

Term and termination

We may suspend or terminate your access if you materially breach these terms, use the service unlawfully, or fail to pay. You may stop using the service at any time. Provisions that by their nature should survive termination — including intellectual property, limitation of liability, and governing law — will survive.

Changes to these terms

We may update these terms. The version in force is the one published on this page at the time of your order. For subscriptions, we will give at least 30 days' notice of material changes; continuing to use the service after that period constitutes acceptance.

Governing law

These terms are governed by the laws of the State of Florida, United States, without regard to conflict-of-law rules. The courts located in Miami-Dade County, Florida, have exclusive jurisdiction, except where mandatory consumer protection law in your country of residence grants you the right to bring proceedings elsewhere. Nothing in these terms deprives a consumer of rights that cannot be waived under the law of their habitual residence.
